GALVESTON — A gas station operator is suing a Sugar Land business, alleging negligence and breach of fiduciary duty.
Om & Dev Shah LLC filed a complaint Dec. 22 in Galveston County District Court against Merchant's Group Inc. alleging the defendant owes at least $200,000.
According to the complaint, in 2010, Om & Dev Shah entered into an exclusive contract for a Conoco Fuel supply, wherein Merchant's Group would fax fuel prices, deliver fuel and invoices within 24 hours, process credit card sales and transfer funds to plaintiff after offsetting unpaid fuel invoices.
As a result of defendant's breach, the suit says the plaintiff suffered substantial loss of profits. The plaintiff alleges Merchant's Group failed to deliver fuel on time, failed to provide fuel daily prices, refused to transfer funds owed to plaintiff and failed to communicate Conoco's imposed compliance orders.
Om & Dev Shah seeks trial by jury, actual and exemplary damages between $200,000 and $1 million, pre- and post-judgment interest, costs of court, attorney fees and all other relief.
