MARSHALL — A welder and machine operator are suing their former employers, Resource West Inc, Pinnacle Companies Inc. and PCI Manufacturing Solutions LLC, citing alleged discrimination, hostile work environment, retaliation and wrongful termination.
Brandon Beauford and Bruce Turman filed a complaint on Dec. 21, in the Marshall Division of the Eastern District of Texas against the defendants, alleging that they violated Title VII of the Civil Rights Act and the Texas Labor Code.
As a result of the defendants' discriminatory and retaliatory actions, the plaintiffs allegedly suffered lost wages, benefits and other compensations as well as emotional pain and suffering, the complaint said. The plaintiffs hold Resource West Inc, Pinnacle Companies Inc. and PCI Manufacturing Solutions LLC responsible because the defendants allegedly subjected them to racial slurs, hostile and derogatory language and discriminatory pay, promotions and working conditions. The companies retaliated against them by firing them for their engagement in protected activity, the complaint said.
The plaintiffs request a trial by jury and seek compensatory and punitive damages, including interest and penalties, attorneys’ fees, expert witness fees, and other costs and relief. They are represented by Jay D. Ellwanger, Gabriel R. Gervey, Holt Major Lackey and Vasilios Manthos of DiNovo, Price, Ellwanger & Hardy LLP in Austin and James Vagnini and Monica Hincken of Valli, Kane & Vagnini, LLP in Garden City, N.Y.
