Coffee company accuses Kawasaki of mishandling merchandise

HOUSTON — A coffee company is suing Kawasaki, alleging negligence in that insufficient measures were taken to prevent damages to a shipped cargo.

Mercon Coffee Corporation filed a complaint Dec. 27 in the Houston Division of the Southern District of Texas against Kawasaki Kisen Kaisha Ltd., alleging failure to maintain the plaintiff's merchandise in good order and condition.

According to the complaint, on Dec. 3, 2015, Mercon Coffee's shipper tendered a containerized cargo of coffee to Kawasaki at Ho Chi Minh City, Vietnam. When delivered to Oakland Dec. 29, 2015, by the cargo ship Bear Mountain Bridge, the suit says, the cargo was not in the same good order and condition. 

The suit says Mercon has sustained damages exceeding $24,589.90. The plaintiff alleges Kawasaki Kisen Kaisha has refused to pay the plaintiff's damages.

Mercon Coffee seeks trial by jury, judgment for all damages, pre- and post–judgment interest, court costs and all other equitable relief. It is represented by attorney Robert C. Oliver of Sharpe & Oliver LLP in Houston.
