Truck driver accuses former employer of discrimination

HOUSTON — A Brazos County truck driver is suing his former employer, alleging employment discrimination.

Rodney Rogers filed a lawsuit Dec. 29 in the Houston Division of the Southern District of Texas against Commercial Metals Company, doing business as CMC Construction Services, alleging violations of provisions of Title VII of the 1964 Civil Rights Act.

According to the complaint, on March 10, 2016, Rogers, who had worked 12 years as the defendant's only full-time black truck driver, was terminated from his employment for asserting his rights to be free from employment discrimination. 

The plaintiff alleges the defendant retaliated against him with increased harassment and ultimately termination of his employment.

Rogers seeks trial by jury, compensatory and punitive damages, attorney fees and expert fees, costs of court, pre- and post-judgment interest and all other equitable relief. He is represented by attorney Kervyn B. Altaffer Jr. of Altaffer & Chen PLLC in Dallas.
