Pilot accuses former employer of age, disability discrimination

MARSHALL — A Gregg County man is suing his former employer, alleging age discrimination and disability discrimination.

Jonathan E. Creech filed a complaint Jan. 3 in the Marshall Division of the Eastern District of Texas against Martin Resource Management Corporation of Kilgore, Texas, alleging violation of the Family Medical Leave Act, the ADA and the Texas Labor Code.

According to the complaint, on June 1, 2015, Creech, who began working for Martin Resource as a pilot in 2010, was terminated from his employment. This came, the suit says, a day after Creech informed the defendant he was ready, willing and able to return to work after receiving treatment for chest palpitations. As a result, the suit says, Creech has suffered lost wages, salary, benefits and/or other employment compensations. 

The plaintiff alleges Martin Resource Management failed and refused to make reasonable accommodations, terminated his employment and refused to reinstate him upon the conclusion of his medical leave.

Creech seeks trial by jury, compensatory, liquidated and exemplary damages, attorney fees, expenses and court costs, pre- and post-judgment interest, injunctive and declaratory relief and all other equitable relief.
