Physician accuses health care providers of fraudulent practices

SHERMAN — A Colorado physician is suing Texas health care providers, alleging fraudulent and unconscionable trade practices.

David Adkinson, of Colorado Springs, individually and on behalf of all others similarly situated, filed a class action complaint Jan. 3 in the Sherman Division of the Eastern District of Texas against Adeptus Health Inc. of Lewisville, Texas, Adeptus Health Colorado Health Holdings LLC, et al, alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, as a proximate result of the defendants' undisclosed facilities fees, Adkinson was damaged monetarily when he was forced to pay some or all of the undisclosed fees. The plaintiff alleges the defendants failed to advise their patients in advance that they would be charged a facilities fee.

Adkinson seeks trial by jury, certification of this case as a class action, appointing the plaintiff as class representative and plaintiff’s counsel as class counsel, compensatory and punitive damages, interest, and all other proper relief. He is represented by attorneys Stuart L. Cochran, L. Kirstine Rogers, Bruce W. Steckler and R. Dean Gresham of Steckler Gresham Cochran PLLC in Dallas.
