Employee accuses eviction service of failure to pay overtime

HOUSTON — A Harris County man is suing an eviction service company, alleging violation of applicable minimum wage law and workers compensation acts in failing to pay overtime.

Dan Russell, individually and on behalf of all others similarly situated, filed a class action complaint Jan. 3 in the Houston Division of the Southern District of Texas against Nationwide Evictions LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, during Russell's employment with Nationwide between Oct. 16, 2013-Oct. 16, 2016, he did not receive minimum wage or overtime pay for the hours he worked of more than 40 per week. 

The plaintiff alleges Nationwide Evictions mis-classified him as exempt from overtime requirements and refused to compensation him at one-and-one-half times his regular rate of pay for all hours worked in excess of 40 a week, in violation of FLSA.

Russell seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime wages, lost wages, liquidated damages, attorney fees and costs and all other proper relief. He is represented by attorneys Alfonso Kennard, Jr. and Ronald E. Dupree Jr of Kennard Richard PC in Houston.
