Pilot blames tugboat operator for injuries

HOUSTON — A Montgomery County man is suing a Houston tugboat operator, alleging negligence led to injuries for the plaintiff.

Daniel Waters filed a complaint Jan. 4 in Harris Circuit Court against Buffalo Marine Services Inc. alleging failure to furnish a seaworthy vessel.

According to the complaint, on May 4, 2016, Waters was employed by Buffalo Marine as a pilot aboard its tugboat San Agustin. While a co-employee was attempting to re-position the tug on its berth, the tug slammed into a barge, the suit says. 

As a result, the lawsuit states, Waters suffered serious injuries resulting in pain and suffering, mental anguish, lost earnings and medical expenses. The plaintiff alleges Buffalo Marine Services failed to provide proper training and supervision to its staff and failed to provide maintenance and cure benefits.

Waters seeks trial by jury, monetary relief of more than $1 million, plus pre- and post judgment interest, costs of suit and all other just and proper relief. He is represented by attorneys Scott C. Krist and Alex W. Horton of The Kirst Law Firm PC in Houston.
