HOUSTON — A Houston man is suing Fiesta Mart, alleging the defendant's negligence led to injuries for the plaintiff.
Edward Horvath filed a complaint Jan. 4 in Harris County District Court against Fiesta Mart LLC, alleging failure to maintain its premises in a safe condition.
According to the complaint, on Jan. 16, 2015, Horvath was shopping at Fiesta Mart's premises, 5235 Katy Freeway, Houston. While walking through the aisle, the suit says, Horvath slipped and fell on a liquid substance on the floor.
The lawsuit states Horvath sustained bodily injuries resulting in physical and mental pain, medical expenses and lost earnings. The plaintiff alleges Fiesta Mart failed to exercise reasonable care in reducing or eliminating the dangerous condition and failed to warn plaintiff of the dangerous condition.
Horvath seeks trial by jury, judgment up to $200,000, pre and post-judgment interest, costs of court and all other equitable relief. He is represented by attorney Robert A. McAllister Jr. of Robert A. McAllister Jr. & Associates PC in Houston.
