Employee blames steel manufacturer for injuries

HOUSTON — A Harris County man is suing a steel manufacturer, alleging their negligence and product liability led to injuries for the plaintiff. 

Gary Lance McManus filed a lawsuit Jan. 11 in Harris County District Court against Bonney Forge Corporation, alleging failure to conduct safety inspections on its products.

According to the complaint, on Feb. 2, 2016, when McManus was working at the Exxon Mobile refinery in Baytown, a bleeder valve failed, causing McManus to be forcefully sprayed with burning hot chemicals. As a result, the suit says, the plaintiff suffered severe burns and injuries to back, legs, arms head and other parts of his body. 

The plaintiff alleges Bonney Forge failed to thoroughly inspect its product before marketing it to the public and acted with flagrant and malicious disregard of the plaintiff’s (and others’) health and safety. The suit says the defendant’s acts and omissions involved an extreme degree of risk considering the probability and magnitude of potential harm.

McManus seeks trial by jury, compensatory, actual, consequential, exemplary damages with pre-judgment/post-judgment interest and all other equitable relief. He is represented by attorneys Jason A. Itkin, Noah M. Wexler and Ben Bireley of Arnold and Itkin LLP in Houston.
