Man alleges 24 Hour Fitness terminated membership because of marital spat with Zumba instructor

GALVESTON – A League City man is suing 24 Hour Fitness USA, Inc. for allegedly terminating his membership in the wake of a personal matter, according to recent Galveston County District Court records.

In a lawsuit filed Jan. 25 in the Galveston County 405th District Court, Salvatore Bonaccorso explains that he was in the midst of divorce proceedings from Eliseo Octaviano Flores, a 24 Hour Fitness Zumba instructor, last year when Flores assaulted him. Per the suit, Bonaccorso advised the defendant’s League City branch of the event in an effort to keep the peace between him and his estranged spouse to no avail as a district manager notified the complainant that he was banned chain-wide.

Bonaccorso asserts that 24 Hour Fitness failed to give him an explanation for the ban, insisting that non-litigant Flores attacked him unprovoked.

“The defendant’s unconscionable conduct in further punishing the victim caused the plaintiff further mental health injury as well as exacerbation of existing mental health injuries,” the original petition says.

A jury trial is requested.
