HOUSTON — A Harris County homeowner is suing a Montgomery County driver, alleging insufficient measures were taken to prevent injuries.
Shellie Frank filed a complaint Jan. 11 in Harris County District Court against Monique Cote, alleging the defendant crashed her vehicle into Frank's residence while driving under the influence of drugs or alcohol.
According to the complaint, on Dec. 28, 2015, Frank was inside her home when defendant crashed into her Harris County residence. The suit says Frank took Cote's keys so she could not flee the scene, causing an altercation.
As a result, the lawsuit says, Frank suffered physical injuries, emotional distress, lost wages and medical expenses. The plaintiff alleges Cote failed to operate her vehicle reasonably and safely, failed to yield right-of-way, drove under the influence of drugs or alcohol and failed to act as a reasonably prudent person.
Frank seeks trial by jury, monetary relief up to $100,000, plus court costs and all other relief the court deems appropriate. She is represented by attorneys Richard J. Presutti, Jaynee M. Tyler and Sondet Francoise Parnell of Law Office of Richard J. Presutti in Houston.
