Visitor blames Marathon Petroleum job site owners for injuries

GALVESTON — A Harris County man is suing property owners, alleging insufficient measures were taken to prevent injuries.

Americo Garza filed a complaint Jan. 10 in Galveston County District Court against The Brock Group LLC, Firetrol Protection Systems, Inc. and Marathon Petroleum Company LP, alleging failure to keep their premises safe to avoid harm to others.

According to the complaint, on Nov. 20, 2014, Garza entered the defendants' premises. At that time, the suit says, an employee for the defendants was working high above Garza and dropped a hose, hitting the plaintiff on his right shoulder with a metal piece on the end of the hose. 

As a result, the lawsuit states, Garza has suffered physical injuries, mental anguish, lost income and medical expenses. The plaintiff alleges the defendants failed to maintain and inspect their premises for dangerous conditions and failed to provide warning of the defective condition of the site.

Garza seeks trial by jury, monetary relief between $200,000 and $1 million and all equitable relief. He is represented by attorneys Loren G. Klitsas and Jared W. Capps of Klitsas and Vercher PC in Houston.
