Consumer accuses RX Pharmacy of invasion of privacy

HOUSTON — A Harris County man is suing RX Pharmacy Services, alleging violation of telephone harassment statutes.

John Woods filed a class action complaint, individually and on behalf of all others similarly situated, Jan. 18 in the Houston Division of the Southern District of Texas against CV McDowell LLC, doing business as RX Pharmacy Services and/or Express RX Pharmacy Service, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, at the time of filing this complaint, Woods has received approximately nine calls from RX Pharmacy attempting to sell a variety of pharmaceutical prescription products. The suit says Woods has been financially harmed, annoyed and harassed. 

The plaintiff alleges the defendant contacted him using an automatic telephone dialing system and/or using an artificial or prerecorded voice and and without prior express consent.

Woods seeks trial by jury, an order certifying this case to be a proper class action, treble damages up to $1,500 and statutory damages of $500 for each call that violated the TCPA, attorney fees and costs of court, plus all other proper relief. He is represented by attorneys Edward C. Snyder and Jesse R. Castillo of Castillo Snyder PC in San Antonio, and by Scott B. Cooper of The Cooper Law Firm PC in Irvine, California.
