HOUSTON — A Fort Bend County woman is suing Stanley Black & Decker and a pipeline company, alleging violation of workers compensation acts in failing to pay overtime.
Sara Sobrinho, individually and on behalf of all others similarly situated, filed a class action complaint Jan. 20 in the Houston Division of the Southern District of Texas against Stanley Black & Decker Inc. and CRC-Evans Pipeline International Inc., alleging they violated the Fair Labor Standards Act.
According to the complaint, Sobrinho typically worked 60 to 65 hours a week as a credit analyst but she was mot compensated at one and one-half times her regular rate for each hour worked more than 40 per week as required by FLSA. The plaintiff alleges the defendants mis-classified her as exempt employee and paid her only a salary without overtime.
Sobrinho seeks trial by jury, proper overtime compensation for all hour worked in excess of 40 per week, liquidated damages, attorney fees, court costs and expenses, plus all other relief.
