Customer alleges used car dealer breached contract

HOUSTON — A Rusk County woman is suing a used car dealer, alleging breach of a motor vehicle sales contract.

Connie Delaney of Henderson filed a complaint Jan. 23 in Harris County District Court against Archer Automotive Inc., doing business as Archer Kia, alleging violation of the Texas Business & Commerce Code.

According to the complaint, on April 4, 2015, Delaney executed a motor vehicle retail installment contract to purchase a used Fleetwood Wilderness travel trailer for $16,523.04. The suit says she paid a $3,000 down payment to Archer Kia for the vehicle. Prior to the sale, Delaney said she informed the defendant that she did not want a FEMA trailer but later found that she had purchased a FEMA trailer. 

The plaintiff alleges Archer Kia misrepresented the origin of the travel trailer.

Delaney seeks trial by jury, monetary relief up to $100,000, revocation of acceptance, pre- and post-judgment interest, attorney fees and court costs, plus all other equitable relief. She is represented by attorney Reginald J. Fox of Lone Star Legal Aid in Houston.
