Tenants blame apartment operators for bedbug bites

HOUSTON — Two tenants are suing Katy apartment operators, alleging fraud by nondisclosure.

Jeremy and Samantha Burks, individually and on behalf of their children Madalynn and Savannah Schlaefer, filed a complaint Jan. 26 in Harris County District Court against Copper Chase Apartments GP LLC and JRK Property Holdings Inc., alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, as a result of the defendants' misrepresentation of the property's condition at 1007 S. Mason Road, Katy, the plaintiffs' daughter sustained personal injuries from bedbug bites that resulted in medical, pharmaceutical and hospital expenses. 

The plaintiffs allege the defendants failed to reasonably inspect and clean the property prior to renting, fraudulently concealed the fact that the property had developed bedbug problems and negligently rented a bedbug-infested property.

Jeremy and Samantha Burks seek trial by jury, monetary relief between $200,000 and $1 million, plus all other equitable relief. They are represented by attorney Tad Rice of The Rice Firm in The Woodlands.
