Family blames auto parts company for relative's death

HOUSTON — A Houston family is suing an auto parts business, alleging its negligence caused the death of a relative. 

Gilbert Gutierrez Jr., Gilbert Gutierrez III and Elena Flores, individually and as representative of the estate of Gilbert Gutierrez Sr., filed a complaint Jan. 31 in Harris County District Court against Auto Used Parts Salvaged LLC, doing business as Auto City Plus, alleging wrongful death in failing to provide a safe place to work.

According to the complaint, on Oct. 14, 2016, Gilbert Gutierrez Sr. was working on Auto City Plus property. While working on a vehicle, the suit says, the vehicle fell on top of Gutierrez and crushed him. He died on the spot. 

The lawsuit states the plaintiffs suffered loss of companionship, love and comfort, mental anguish and grief and medical and funeral expenses. The plaintiffs allege Auto City Plus failed to properly train and supervise its workers regarding safety regulations and automobile industry standards.

The plaintiffs seek trial by jury, monetary relief of more than $1 million and all other equitable relief. They are represented by attorney Ryan E. Rogers of Godsey Law Firm in Dallas.
