TYLER — A Van Zandt County man is suing tractor trailer operators, alleging their negligence caused a fatal crash.
Ray Potter, individually and as representative of the estate of Jerry Lee Potter, filed a complaint Feb. 8 in the Tyler Division of the Eastern District of Texas against Robin Express Inc. and Barjinder Singh of Manteca, California, alleging Robin Express failed to properly train and supervise its employee.
According to the complaint, on Sept. 23, 2016, Jerry Lee Potter was traveling westbound on U.S. Highway 80 in Wood County when suddenly Singh, who was operating a tractor trailer owned by Robin Express, crossed into and effectively blocked the westbound lane of traffic.
The suit says Potter's vehicle crashed in the outside lane of westbound traffic, causing Potter's death.
The suit says Ray Potter suffered loss of consortium and services and funeral expenses. He alleges Singh failed to keep a proper lookout and failed to operate the vehicle as a reasonable and prudent manner.
Ray Potter seeks trial by jury, judgment in excess of the minimum jurisdictional limits of the court, costs of court, pre- and post-judgment interest and all other relief. He is represented by attorneys Darren Grant and Matthew B. Flannery of Grant & Flanery PC in Tyler.
