Truck driver alleges employer failed to pay overtime

HOUSTON — A Houston truck driver is suing his employers, alleging violation of workers compensation acts in failing to pay proper overtime.

Juan Molina filed a complaint Feb. 8 in the Houston Division of the Southern District of Texas against McKaskle Industrial Complex Inc., doing business as Westside Recycling and Auto Salvage, and Souhail Adam, alleging violation of the Fair Labor Standards Act.

According to the complaint, from Dec. 16, 2015, to the present, Molina has worked in excess of 40 hours per week for the defendants as a truck driver but was not paid any overtime wages. The plaintiff alleges the defendants failed to pay overtime premium at a rate of one and one-half times his regular hourly rate for each hour worked more than 40 in any week, as required by FLSA.

Molina seeks trial by jury, unpaid overtime, liquidated damages, injunctive relief, declaratory relief, attorney fees and court costs and all further relief the court deems just and proper. He is represented by attorneys Charles L. Scalise and Daniel B. Ross of Ross Law PC in Austin.
