Waitress alleges restaurant operator failed to pay overtime

HOUSTON — A Harris County woman has filed a class action lawsuit against a restaurant operator, alleging violation of workers compensation acts in failing to pay overtime.

Christina Bryant filed a complaint, individually and on behalf of all others similarly situated, on Feb. 10 in the Houston Division of the Southern District of Texas against Southern Komfort Kitchen LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, between February 2015 and Jan. 29, 2016, Bryant regularly worked 35 to 45 hours per week as a waitress without receiving the statutory minimum wage rate and proper overtime compensation. The plaintiff alleges Southern Komfort Kitchen required her to participate in a tip pool, misappropriated tips and failed to pay the required minimum wage and overtime rate.

Bryant seeks trial by jury, all unpaid wages and misappropriated tips, liquidated damages and all other equitable relief. She is represented by attorneys Todd Slobin, Ricardo J. Prieto and Dorian Vandenberg-Rodes of Shellist Lazarz Slobin LLP in Houston.
