HOUSTON — Harris County's health unit is suing a bus passenger and her attorney, alleging illegal conversion.
Harris Health System filed a complaint Feb. 15 in Harris County District Court against Benssy Moni of Missouri City, Texas, and attorney Ehsanur Rahman, alleging they intentionally converted the plaintiff's property by taking third party settlement money.
According to the complaint, Harris Health paid medical bills on behalf of Moni for $3,190.40, due to injuries she sustained while riding a bus owned by SSL Transportation on Nov. 28, 2012 when the bus driver suffered a fatal heart attack. The suit says Moni received $15,000 from the transportation company, of which $3,190.40 is subject to the plaintiff's statutory worker's compensation lien.
To date the statutory lien remains unpaid, the lawsuit states. The plaintiff alleges despite repeated demands for payment, the defendants have been unresponsive and refused to remit the amount due to the plaintiff under the Workers Compensation Act.
Harris Health System seeks trial by jury, monetary relief of up to $100,000 and all other equitable relief. It is represented by attorney Garland "Mack" McInnis of Houston.
