Couple sue hotel operator over son's pool injury

GALVESTON — A couple are suing the operator of Moody Gardens Hotel, alleging that insufficient measures were taken to prevent injuries to their son, who lacerated his foot while playing in the hotel swimming pool.

Keith Bibbins and Ellen Scott filed a complaint on Feb. 23 on behalf of minor Miles Bibbins, in the Galveston County District Court against the defendant, alleging that the hotel operator breached its duty of reasonable care to ensure the safety of its guests.

According to the complaint, the plaintiffs allege that their minor son was a guest at the hotel. While swimming, he suffered a severe laceration to his foot and other physical injuries due to broken glass that had accumulated at the bottom of the pool.

The plaintiffs suffered medical expenses, mental anguish and lost wages, their complain said. The plaintiffs hold Moody Gardens Inc. responsible because the defendants allowed guests to bring glass containers into the pool area and allegedly failed to exercise reasonable care to keep guests safe.

The plaintiffs request a trial by jury and seek monetary relief of more than $100,000 but less than $200,000 and such any additional relief they may be entitled to. They are represented by Kenneth Baird of The Baird Law Firm in Houston.
