Houston residents sue home builder, contractor

HOUSTON — Two property owners are suing Landmark Homebuilders Inc. and contractor Charles A. Jorgensen, citing an alleged breach of fiduciary duty.

Alexander Rosca and Marcela Halmagean filed a complaint on Feb. 27, in the Harris County District Court against the defendants, alleging that they violated the Texas Property Code provisions.

According to the complaint, the plaintiffs allege that as a result of the defendants' breaches, they have suffered substantial damages, including additional taxes, fees, loan interest, costs of repairs and the inability to sell their current home. The plaintiffs hold Landmark Homebuilders and Jorgensen responsible because the defendants allegedly failed to manage and supervise the project and subcontractors, refused to continue the work on the project, misappropriated funds allocated for the building of the plaintiffs' home and paid costs associated with the defendants' other building projects.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million and other relief to which they may be entitled.
