Customer sues restaurant operator

Houston resident accuses VKC 1 LP (d/b/a Subway) of negligence.

HOUSTON — A customer is suing VKC 1 LP d/b/a Subway, a restaurant operator, citing alleged insufficient measures were taken to prevent injuries.

Juan Rodriguez filed a complaint on March 1, in the Harris County District Court against VKC 1 LP d/b/a Subway alleging that the restaurant operator negligently sold a product that was not fit for consumption.

According to the complaint, the plaintiff alleges that, in May 20, 2015, he became severely ill after consuming a tuna sandwich he purchased from defendant's restaurant. He was caused to suffer pain, anxiety, disfigurement and incurred medical expenses. The plaintiff holds VKC 1 LP d/b/a Subway responsible because the defendant allegedly failed to properly inspect food for spoilage and contamination and failed to serve the public a safe and edible product.

The plaintiff requests a trial by jury and seeks damages of less than $100,000 and such other and further relief. He is represented by Jordan A. Glaze and Josh Garrett of Glaze | Garrett in Gilmer.
