Licensed vocation nurse sues home health care providers

Montgomery County resident accuses home health care providers of unpaid wages

HOUSTON — A licensed vocation nurse has filed a class-action lawsuit against Star Home Health Inc. and Clementina Ikwuezunma, home health care providers, citing alleged violation of workers compensation acts.

John Paradysz filed, individually and on behalf of all others similarly situated filed a complaint on March 1, in the Houston Division of the Southern District of Texas against the defendants alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that, he has worked significant number of hours, including overtime hours without receiving overtime pay. The plaintiff holds Star Home Health Inc. and Clementina Ikwuezunma responsible because the defendants allegedly failed to compensate him at a rate of not less than one and one-half times his regular rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks actual and liquidated damages, interest, court costs and all other relief to which he may be justly entitled. He is represented by Edwin Sullivan of Oberti Sullivan LLP in Houston.
