SHERMAN — Former employees have filed a class-action lawsuit against an alcoholic beverages retailer, citing alleged violation of workers compensation acts.
Kristopher Leach and Bryan Freeland filed a complaint individually and on behalf of all others similarly situated on March 2, in the Sherman District of the Eastern District of Texas against Fine Wines and Spirits of North Texas LLC, alleging that the wine and liquor retailer violated the Fair Labor Standards Act (FLSA).
According to the complaint, Kristopher Leach and Bryan Freeland allege that during their employment in the year 2000 with the defendant, they were not properly compensated for all time they worked and that they were fired for pretextual reasons. The plaintiffs hold Fine Wines and Spirits of North Texas LLC responsible because the defendant allegedly automatically deducted 30 minutes from their work day for a lunch break that they did not take and failed to pay minimum wage and overtime compensation at the rates required by the FLSA.
The plaintiffs request a trial by jury and seek compensation for all unpaid wages, liquidated damages, court costs, interest and all other legal or equitable relief. They are represented by Matthew Scott and Javier Perez of Scott Perez LLP in Dallas.
