Buyer alleges property seller violated contract

HOUSTON — A Harris County property buyer is suing a property seller, alleging breach of contract.

CMOQ Investments LLC of Katy filed a complaint March 7 in Harris County District Court against Kimberly McGlory, alleging failure to perform her contractual obligations.

According to the complaint, on Jan. 25, CMOQ entered into a contract to purchase McGlory's property at 1608 Wheeler St., Houston. Between Feb. 16 and Feb. 19, the suit says, CMOQ contacted the defendant to close on the property but was unsuccessful. 

The plaintiff alleges McGlory has refused to tender the property at the agreed price and has ignored all efforts by CMOQ to close the property within the requisite period of time.

CMOQ Investments seeks trial by jury, monetary relief between $100,000 and $200,000 and all other equitable relief. It is represented by attorney Sylvester J. Williams of Houston.
