Tenant blames apartment complex operator for illness

HOUSTON — A Houston woman is suing a Woodlands apartment complex operator, alleging its negligence caused her to become ill. 

Virginia Carter filed a complaint March 7 in Houston Division of the Southern District of Texas against Southstar Management LLC, alleging failure to ensure the safety and well-being of its residents.

According to the complaint, in November 2015, Carter began to experience serious health problems after being exposed to mold at her residence at 8900 Research Drive, The Woodlands. On Feb. 11, 2016, the suit says, Carter was admitted to the intensive care at St. Luke's Hospital unit and was placed in isolation for several days. 

The lawsuit states she incurred medical expenses of more than $75,000 and suffered mental anguish and distress as well as pain and suffering. The plaintiff alleges Southstar Management failed to properly repair the air conditioning unit in her apartment and breached its legal duty of care to provide a habitable residence.

Carter seeks trial by jury, compensatory, exemplary and treble damages, pre- and post-judgment interest, attorney fees and court costs and all other just relief.
