Harris County homeowner accuses remodeling contractors of deceptive trade practices

HOUSTON — A Harris County homeowner is suing remodeling contractors, alleging breach of warranty and fraud.

Terrill Garr filed a complaint March 8 in Harris County District Court against Justin Simmons, individually and doing business as Versa Corp Flooring and Remodeling, and Versa Corp Management LLC, alleging violation of the Texas Business and Commerce Code.

According to the complaint, on Dec. 4, 2015, Garr hired the defendants to repair a leak in the roof of his Harris County home. Due to the un-workmanlike manner in which the work was done, the suit says, the leaks still persisted and became worse. 

The suit says Garr was forced to hire a new contractor for $19,752.38. The plaintiff alleges the defendants failed to honor their two-year warranty and refused to remedy the damages.

Garr seeks trial by jury, actual and economic damages, interest, attorney fees, costs of court and all other relief the court allows. He is represented by attorney Gene A. Watkins of Sherman Watkins PLLC in Houston.
