Capital One accuses guarantors of breach of contract

HOUSTON — Capital One is suing guarantors of a promissory note, alleging breach of guaranty agreements.

Capital One National Association filed a complaint March 8 in the Houston Division of the Southern District of Texas against The Tifaro Group, Ltd., Greater Houston Emergency Physicians PLLC, Jason Lebwohl, Gary Yee,et al alleging they failed to perform their obligations under the agreements.

According to the complaint, EC Mansfield LLC executed and delivered to Capital One a promissory note dated May 19, 2014, for $2.4 million and a revolving line of credit promissory note for $500,000. The suit says the defendants irrevocably and unconditionally guaranteed the full payment of Mansfield’s indebtedness. 

To date, the lawsuit states, the said amounts have not been fully paid. The plaintiff alleges the defendants have continued to refuse to pay the amounts due and owing.

Capital One seeks trial by jury, all sums due the plaintiff, pre- and post-judgment interest, attorney fees, costs of court and all other relief. It is represented by attorneys Richard A. Howell and Jamila M. Brinson of Jackson Walker LLP in Houston.
