Ex-employee accuses Wal-Mart of wrongful termination

GALVESTON — A Brazoria County man is suing Wal-Mart, alleging wrongful termination and gender discrimination.

James A. Davis of Angleton filed a complaint March 14, in the Galveston Division of the Southern District of Texas against Wal-Mart Stores of Texas LLC, alleging violation of Title VII of the 1964 Civil Rights Act.

According to the complaint, as a result of his wrongful termination, Davis was unemployed for seven months, resulting in lost wages in the approximate amount of $7,560. The suit says he was unable to further his education because he had no means of paying tuition and fees. Davis alleges he has experienced pain and suffering valued at $250,000. 

The plaintiff alleges the defendant failed to provide reasonable accommodations, and discriminated and retaliated against him by terminating his employment for filing a complaint of gender discrimination after he sought a transfer to a Wal-Mart store in the Austin area.

Davis seeks trial by jury, compensatory and punitive damages, court costs, attorney fees and all other just and proper relief. He is represented by attorney Veronica L. Davis of West Columbia.
