Patient accuses medical care providers of negligence

GALVESTON — A Brazoria County man is suing medical care providers, alleging their negligence caused him to become ill. 

Diego Morales filed a complaint March 15 in Galveston County District Court against UTMB Healthcare Systems Inc. and Dr. Kimberly M. Brown, alleging they breached their duty to perform a safe surgical operation.

According to the complaint, on Feb. 6, 2014, Morales underwent a surgery to remove a cyst on his pancreas performed by the defendants at University of Texas Medical Branch. As a result of the defendants' negligence, the suit says, Morales became very sick and was put on antibiotics and ultimately dialysis. 

The suit states Morales has suffered physical and mental pain, loss of wages and medical expenses. The plaintiff alleges the defendants failed to remove a wire, sutures and a 1-foot gauze from his body prior to completing the surgery and failed to act immediately when he began having serious issues.

Morales seeks trial by jury, monetary relief of more than $1 million, plus all equitable relief. He is represented by attorney Joshua P. Davis of Davis Law Group in Houston.
