HOUSTON — A baker has filed a class action lawsuit against his former employers, alleging violation of workers compensation acts in failing to pay overtime.
Juan Espinosa, individually and on behalf of all others similarly situated, filed a complaint March 29 in the Houston Division of the Southern District of Texas against R & D Tierra Caliente Inc., doing business as Panaderia Tierra Caliente, Ruben Arguello, Fernando Duque, et al, alleging they violated the Fair Labor Standards Act.
According to the complaint, during Espinosa's employment with the defendants between 2008 and 2017, he was paid the same salary rate for all hours worked. The suit says he was not paid one and one-half times his regular rate of pay for the hours he has worked over 40 a week as required by FLSA.
Espinoza seeks trial by jury, unpaid minimum and overtime wages, liquidated damages, interest, attorney fees, court costs and all other just and equitable relief. He is represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
