Nurse assistant alleges employers failed to pay overtime

HOUSTON — A Harris County woman is suing joint employers, alleging violation of workers compensation acts in failing to pay overtime.

Natcha Miles-Brown filed a complaint March 29 in the Houston Division of the Southern District of Texas against Love & Joy Personal Care Home and Lover Compton, alleging they violated the Fair Labor Standards Act.

According to the complaint, Miles-Brown regularly worked as a certified nurse assistant at Love & Joy Personal Care Home more than 40 hours per week without receiving proper overtime compensation for all hours worked in excess of 40 per week. 

The plaintiff alleges the defendants intentionally failed to compensate her at a rate not less than one and one-half times the regular rate for each hour worked in excess of 40 a week as required by FLSA.

Miles-Brown seeks trial by jury, unpaid overtime wages, liquidated damages, attorney fees, court costs, expert fees, out of pocket expenses and all other proper and equitable relief. She is represented by attorneys Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
