Behavioral technician alleges autism therapy center failed to pay overtime

SHERMAN — A Denton County behavioral technician is suing autism therapy center operators, alleging violation of workers compensation acts in failing to pay overtime.

Felicia Murphy filed a complaint March 29 in the Sherman Division of the Eastern District of Texas against ABA Ranch LLC, Roberta Lynn Hawkins and Stephen Reed, alleging they willfully violated the Fair Labor Standards Act.

According to the complaint, Murphy normally worked in excess of 40 hours per week without receiving proper overtime compensation for any hours worked over 40 per week. The plaintiff alleges the defendants failed to pay overtime compensation as required by FLSA and failed to maintain accurate employee pay records.

Murphy seeks trial by jury, unpaid overtime compensation, liquidated damages, attorney fees, litigation costs, pre- and post-judgment interest and all other proper and equitable relief. She is represented by attorney Douglas B. Welmaker of Dunham & Jones PC in Austin.
