Woman sues Blue Bell over contaminated ice cream

GALVESTON – A Galveston County woman has pursued legal action against Brenham-based Blue Bell Creameries on allegations that she and her young daughter ate contaminated ice cream two years ago.

Ursula Burton filed a lawsuit against the company on behalf of herself and the girl on Apr. 18 in the Galveston County 10th District Court.

Court documents explain that Burton bought the product in question at a local Valero store on Apr. 18, 2015. Per the original petition, the plaintiffs “became violently ill” after consuming the ice cream.

“As a result of eating the contaminated Blue Bell ice cream, plaintiff Ursula Burton was diagnosed with listeriosis,” the suit says. “Subsequently she has become lactose intolerant. V.B. has also developed a sensitivity to dairy.”

The complainants’ ordeal was reportedly among the number of listeria-related cases that Blue Bell faced. These cases forced the business to cease operations until sanitary issues were resolved.

Consequently, the plaintiffs seek unspecified monetary damages.

They are represented by attorney Mark O. Midani of The Midani Law Firm in Houston.
