Welder alleges employers failed to pay overtime

HOUSTON — A welder has filed a class action lawsuit against two employers, alleging violation of workers compensation acts in failing to pay overtime.

Marco Salazar, individually and on behalf of all others similarly situated, filed a complaint March 31 in the Houston Division of the Southern District of Texas against Ensign United States Drilling Inc., and Express Payroll Inc.,alleging violation of the Fair Labor Standards Act.

According to the complaint, during Salazar's employment with the defendants as a welder from January 2014 to January 2015, he regularly worked more than 40 hours per week without being paid proper overtime compensation. 

The plaintiff alleges the defendants denied him overtime compensation at the rate of time and a half his regular rate for all overtime hours worked as required by FLSA and paid him straight time only.

Salazar seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime compensation, liquidated damages, attorney fees and court costs and all other relief. He is represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
