Customer alleges Fiesta Mart's negligence led to injuries

HOUSTON — A Harris County woman is suing Fiesta Mart, alleging negligence caused physical injuries to the plaintiff.

Winnell Texada filed a complaint April 10 in Harris County Circuit Court against Fiesta Mart, LLC. alleging failure to properly maintain the market in a safe and secure manner such that the premises posed an unreasonable hazard to customers.

According to the complaint, on April 10, 2015, Texada was a customer at the Fiesta Mart on Mykawa Road in Houston. She says she fell backward and landed flat on her right hand while approaching the counter at the seafood section of the store. As a result, the suit says, Texada suffered a fractured wrist, physical pain and injuries, mental anguish and medical expenses. 

The plaintiff alleges Fiesta Mart LLC failed to make the condition reasonably safe and failed to adequately warn customers of the condition.

Texada seeks trial by jury, monetary relief of $100,000, costs of suit, pre-and post-judgment interest and all other just relief. She is represented by attorney Roxell Richards of Houston.
