4 residence owners allege Farb Apartments breached warranty

HOUSTON — Four Houston residence owners are suing Farb Apartments, alleging breach of warranty and workmanlike services.

Nicholas Harley Smith, Jocelyn Fleur Smith, Kevin Gerard Spearman and Tristan Carson Hager filed a complaint April 28 in Harris County District Court against Farb Homes Inc. Farb Apartment Homes Inc. JF1219PTGP LLC. 1219 Peden Townhomes Ltd. and Jonathan Farb, alleging failure to comply with the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiffs suffered financial damages from the loss of sale of their units, had to expend substantial sums to repair the defects in their homes and were forced to rent temporary housing during the repair time at 1219 Peden St., Houston. 

The plaintiffs allege the defendants breached their duty to construct the plaintiffs' residences in a manner that prevents moisture and water damage to their homes.

The plaintiffs seek trial by jury, monetary relief between $200,000 and $1 million, plus legal interest, costs of this action and all other relief. They are represented by attorneys Gary Linn Evans and George Andrew Coats of Coats & Evans PC in The Woodlands.
