Man files suit against Guru Transport, driver after FM 2199 collision

MARSHALL – A Jefferson County man alleges he was injured on FM 2199 when another driver failed to yield to the right-of-way.

Jerry Powell filed a complaint on May 3 in the Marshall Division of the Eastern District of Texas against Iqbal Singh and Guru Transport alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 7, 2016, while driving northbound on FM 2199 in Harrison County, a Guru Transport vehicle driven by Singh failed to yield to the right-of-way and into the path of plaintiff, causing his right back quarter to collide with the plaintiff's left front quarter. As a result, Powell claims he suffered physical injuries, loss of earnings and medical expenses. 

The plaintiff holds Singh and Guru Transport responsible because defendant Singh allegedly failed to keep a proper lookout, failed to turn the motor vehicle to avoid collision and failed to stop, yield and grant immediate use of the intersection to conform to the official traffic-control device.

The plaintiff requests a trial by jury and seeks payment for damages, together with pre- and post-judgment interest, costs of court and such other and further relief to which the plaintiff may be entitled at law or in equity. He is represented by Josh B. Maness of Josh B. Maness in Waskom.
