Customer blames Dairy Queen for injuries

HOUSTON — A Harris County woman is suing Dairy Queen, alleging negligence caused her to fall at a store.

Olivia Myers filed a complaint April 20 in Harris County District Court against Aul Enterprises Inc., doing business as Dairy Queen, alleging failure to keep the property reasonably safe for business invitees.

According to the complaint, on May 28, 2016, Myers was injured when she slipped and fell due to a liquid substance that was left on the floor of a Dairy Queen in Baytown. The suit says Myers suffered injuries to her neck, back and other parts of her body.

The plaintiff alleges Dairy Queen failed to remove any liquid substance on the floor of its premises.

Myers seeks monetary relief up to $100,000 to treat her injuries, court costs, pre- and post-judgment interest, and all other just relief. She is represented by attorney Wes Klinger Jr. of Wes Klinger Law Office PLLC in Beach City.
