General contractor alleges former employee, competitor broke law

GALVESTON — A Galveston general contractor is suing a former employee and a competitor, alleging tortious interference with business relationship.

DSW Homes LLC filed a complaint May 1 in Galveston County District Court against George Johnson and Ducky Johnson Home Elevation LLC, alleging Johnson breached his contractual obligations not to compete with the plaintiff.

According to the complaint, DSW Homes has suffered and will continue to suffer economic loss, a damaged business relationship, loss of good will and reputation and a permanent loss of trade secrets and confidential information because Johnson failed to comply with his restrictive covenant and common law duties and obligations by soliciting the plaintiff's customers and vendors to terminate their business relationships with DSW Homes and by disclosing and the using plaintiff's proprietary information and trade secrets.

DSW Homes seeks trial by jury, a temporary restraining order prohibiting the defendants from soliciting business from the plaintiff's customers, monetary relief between $200,000 and $1 million and all other just and equitable relief.
