HOUSTON — A woman is suing a retail chain store for allegedly failing to prevent her from falling on a wet floor.
On April 24, Ashley Wilkerson filed a complaint in the Harris County Circuit Court against 99 Cents Only Stores LLC, alleging that the defendant failed to exercise ordinary care in maintaining premises to avoid any injuries to others.
According to the complaint, the plaintiff alleges plaintiff slipped on a wet substance which had accumulated on the floor of the store on June 2, 2016. As a result, Wilkerson claims she suffered physical injuries, loss of earning capacity and incurred medical expenses.
The plaintiff holds the defendant responsible for allegedly failing to remedy or correct the condition and warn patrons of the danger.
The plaintiff requests a trial by jury and seeks judgment for actual and compensatory damages, pre- and post-judgment interest, costs of suit, attorney's fees and further relief to which she may be justly entitled.
