California doctor accused of breach of contract involving medical technology

Contract 09

HOUSTON — An individual is suing Dr. Ferid Murad, a California resident, citing alleged breach of contract.

Dr. Cheng-Shing Chen filed a complaint on March 31 in the Houston Division of the U.S. District Court for the Southern District of Texas, alleging that the defendant failed to indemnify him after the purported beach of contract.

According to the complaint, the plaintiff alleges that he was financially damaged after the defendant failed to perform his part of a contractual obligation. The plaintiff holds the defendant responsible for failing to authorize the "worldwide exclusive use" of technology involving nitric oxide that he had developed in exchange for a $2 million capital contribution from the plaintiff.

The plaintiff seeks actual damages, pre- and post-judgment interest, attorney's fees, court costs, general and special damages and other relief to which the plaintiff may be entitled. He is represented by Christine Kirchner of Chamberlain, Hrdlicka, White Williams & Aughtry in Houston.
