Man accuses Volume Transportation driver of negligence after fatal accident

TYLER – A Smith County widower has filed suit against a tractor-trailer driver and the driver's employer after a fatal accident.

Willard Lecroy, individually and on behalf of the estate of Lilia Lecroy, deceased, and Edward Lecroy filed a complaint on May 9 in the Tyler Division of the Eastern District of Texas against Volume Transportation Inc. and Mario Saucedo alleging negligence

According to the complaint, on Feb. 3, 2017, Saucedo, during the scope of his employment with Volume Transportation, was driving a 2017 Cascadia Freightliner and trailer failed to slow down for a yellow light at the intersection of U.S. 271 and the loop extension. The suit states Saucedo entered the intersection as the light turned right and struck Jessica Lecroy's vehicle, killing Lilia Lecroy and injuring Edward Lecroy, who were passengers.

The plaintiff holds Volume Transportation Inc. and Saucedo responsible because defendant Saucedo allegedly failed control his speed and to stop at the proper place, failed to maintain a proper lookout and failed to yield right of way.

The plaintiff requests a trial by jury and seeks award of damages, costs, pre- and post-judgment interest and such other just and proper relief. He is represented by Marisa Schouten of Martin Walker PC in Tyler.
