Production manager alleges employer failed to pay overtime

HOUSTON — A production manager is suing a continuing care business, alleging violation of workers compensation acts in failing to pay overtime.

Aundria M. Sims filed a complaint on May 12, in the Houston Division of the Southern District of Texas against Broadmoor Continuing Care Center Ltd. Co. alleging violation of the Fair Labor Standards Act.

According to the complaint, Sims who has worked as a cook and production manager for Broadmoor since October 2016, suffered monetary damages for not receiving the statutory minimum wages and overtime premium for all hours worked more than 40 per week. 

The plaintiff alleges Broadmoor Continuing Care Center willfully refused to pay her the overtime premium at the statutory rate of one and one-half her regular rate for all hours worked in excess of 40 per week as required by FLSA.

Sims seeks trial by jury, unpaid minimum wages and overtime compensations, liquidated damages, court costs, attorney fees and all other just and equitable relief. She is represented by attorneys Josef F. Buenker and Thomas H. Padgett Jr. of The Buenker Law Firm in Houston.
