Family blames tractor-trailer operators for causing crash

MARSHALL — A family is suing a trucking business and driver, alleging their negligence caused a crash that injured the plaintiffs. 

Muhammed Mughal and Tanzilla Mughal, individually and as parent and next friend for S.M. and U.M., minor children, Mirza Mughal, as parent and next friend for A.M., a minor child, filed a complaint May 12 in the Marshall Division of the Eastern District of Texas against Applegate Trucking LLC and Justin Dean Brown, alleging Applegate negligently entrusted its motor vehicle to an unlicensed, incompetent and careless driver.

According to the complaint, on Sept. 28, 2016, plaintiffs were severely injured when Brown, pulling an Applegate trailer, caused a crash in Longview by running a stop signal and running into the plaintiffs' Toyota Sienna. The suit says the plaintiffs incurred medical expenses, pain and suffering, mental anguish and loss of earning capacity. 

The plaintiffs allege Brown totally disregarded the traffic signalling device and violently struck the plaintiffs' vehicle with tremendous force.

The plaintiffs seek actual damages, plus legal interest, costs of court and all other relief. They are represented by attorneys Brent Goudarzi, Marty Young, John Hull and Geoffrey Hoover of Goudarzi & Young LLP in Gilmer.
