HOUSTON – A former ranch hand for an equestrian facility in Magnolia has filed a class-action lawsuit against its owners and operators over allegations that he was improperly classified as an independent contractor and that he was not paid the correct overtime rate.
Pedro Camposano, individually and on behalf of all others similarly situated, filed a complaint on May 19 in the Houston Division of the Southern District of Texas against Scarlet N Grey LLC, Infinity-Texas Development Inc. Donald Tandy, Tracy Tandy and David Antonio alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he was employed by the defendants between July 1, 2015, and Sept. 21, 2016. He alleges he was paid the same amount each week no matter how many hours he worked.
The plaintiff holds Scarlet N Grey LLC, Infinity-Texas Development Inc., Donald Tandy, Tracy Tandy and Antonio responsible because the defendants allegedly failed to pay appropriate overtime wages for all hours worked in excess of 40 hours in a workweek.
The plaintiff requests a trial by jury and seeks award for all unpaid wages, liquidated damages, costs and attorney’s fees and such other proper and just relief. He is represented by Gregg M. Rosenberg and Tracey D. Lewis of Rosenberg & Sprovach in Houston.
