SHERMAN — A Texas consumer has filed a class action lawsuit against an oil and gas exploration company, alleging violation of telephone harassment statutes.
George Morris, individually and on behalf of all others similarly situated, filed a complaint May 23 in the Sherman Division of the Eastern District of Texas against Hornet Corporation, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, on Aug. 15, 2015, Morris began receiving telephone calls from Hornet seeking to sell investments in oil and gas properties. As a result of defendant's unlawful conduct the plaintiff said he was harassed, abused and inconvenienced.
The plaintiff alleges Hornet placed calls without Morris' prior express written consent.
Morris seeks trial by jury, an order certifying this claim as class action, statutory damages of $500 for each violation with triple damages for any willful violation, attorney fees and court costs, plus all relief that is just and equitable.
